The state Court of Appeals has declined to review the sex abuse case of former Onondaga Nation School teacher Albert Scerbo, leaving the matter to be tried again in Onondaga County Court.
Judge William Walsh is scheduled to meet with the lawyers today to discuss scheduling that trial.
Scerbo, 46, of Clay, was convicted in August 2007 of first-degree sexual abuse and endangering the welfare of a child involving allegations he molested a 7-year-old female student. Walsh set aside the conviction, ruling deliberations had been improperly swayed by two jurors with teaching backgrounds.
The state Supreme Court Appellate Division in Rochester ruled in February that Walsh was correct in setting aside the conviction. But that court also reinstated two charges - felony course of sexual conduct against a child and misdemeanor endangering involving another victim - that Walsh dismissed before trial.
Scerbo originally was named in a 35-count indictment accusing him of endangering the welfare of 17 female students and sexually molesting 16 of them.
